Formal and informal remedies for dealing with nuisance and ASB

Criminal behaviour order (CBO)

  • This is a court order which can be used following a conviction for any criminal offence in any criminal court.  It replaces the ASBO on conviction.
  • It can include prohibitions and positive requirements, for example, attending an anger management course.  It is aimed at tackling the most serious and persistent offenders.
  • Either councils or the police can ask the CPS to apply for one.
  • It is used to prevent harassment, alarm or distress if P2 has committed a criminal offence which has caused harassment, alarm or distress to someone.
  • A typical use in the context of noise might be where there is drunk and rowdy behaviour.
