Civil injunctions

These can cover a range of ASB and can be used for adults and children upwards of 10 yrs of age.

  • For housing related ASB this has to be capable of causing nuisance or annoyance in relation to someone's occupation of a residential property.

It can impose positive requirements as well as prohibitions (e.g requiring someone to attend a course).  A breach is punishable as civil contempt of court. 

  • For adults up to two years in prison.
  • For children a supervision order, curfew or activity requirement or, in severe cases, a detention order. 

For adults the injunction can be for a fixed time or indefinite but for under 18s there must be a specified time limit up to 12 months.

A power of arrest can be attached for any prohibition.
