Secure tenancies

Security of tenure

We can only take possession of a home of a secure tenant by:

  • Going to court.
  • Accepting a surrender of tenancy.
  • Being served with a valid notice to quit.
  • If a court has made an order to demote a tenancy due to ASB.

Right to improve

Secure tenants have this right, however, we must first give our permission in writing.  Introductory tenants do not have this right.

We will not unreasonably refuse our permission however satellite dishes will only be allowed in exceptional circumstances and security grilles and gates must meet London Fire and Emergency Planning Authority safety guidelines.

Right to be consulted

All tenants have the right to be consulted and have their views considered on how we manage their homes.  They also have a right to be informed about our allocation policy.

Right to see information we hold about them

Although the tenancy conditions say there is a £10 charge if tenants want a copy of their records the GDPR abolished this charge and we provide these for free.

Right to have a lodger

and sublet part of a home but not to sublet the whole property.  Introductory tenants do not have this right.

Right to buy

with a discount after being a public sector tenant for 3 years.  Time spent as an introductory tenant counts towards this.  This doesn't apply to sheltered housing tenants or homes that have been adapted.

Right to swap homes

by mutual exchange with another council or housing association tenant with our permission.  Introductory tenants do not have this right.

Right to pass on a tenancy 

if there hasn't been a previous succession.  Rules around this are complicated so it's always best to check the guidance first.
