Assignments

An assignment is the transfer of a tenancy by the tenant to another person. The Housing Act 1985 sets out when this can be done. Unless an assignment is by court order or under the right to exchange, tenants can only assign their tenancy to someone who has a legal right to succeed and to be valid an assignment must be done by Deed. For these reasons this guidance needs to be prescriptive.

You can read the full guidance here.

Typically a tenant may way want to transfer their tenancy to a family member if they are moving out (for example if they are going into a care home or nursing home) or if they have a terminal illness. When an assignment is possible it can be a better option than relying on succession as it can provide certainty and peace of mind.  Assignment is not a well-known option so, in an appropriate case, it may be a possibility to flag up.
