Ending a tenancy when someone lacks capacity

These cases can appear to be complex and potentially drag on so we have developed a protocol with adult social care in line with the Mental Capacity Act to end a person's tenancy.   

Surrendering a tenancy to enter the hostels pathway

A tenant can surrender their tenancy and be assured that when they are considered well enough to live independently they will be allocated sufficient points to enable them to bid for another council property.

To apply for this scheme, a tenant fitting the criteria should be referred to the Vulnerability Panel by the neighbourhood housing/rent service officer or other professional supporting the tenant.
