The Council’s clear message to tenants who perpetrate domestic violence or abuse is that it will not be tolerated. DVA explicitly breaks the conditions of tenancy. It is a ground for possession of a secure tenancy in the Housing Act (HA)1985. Action against perpetrators can help keep the survivor safe (as well as potential future victims) and can increase their options. Here are some options to help you deal with perpetrators of DVA.
There may be other legal remedies available to the Council. These could include demotion of a tenancy or an injunction to enforce the tenancy conditions pending eviction. Liaise with the IDSVA supporting the tenant and ask for legal advice on the options early on.
There are legal remedies and sanctions available through the courts to help domestic abuse survivors, such as restraining orders, non-molestation orders, and occupation/transfer orders.
