Safeguarding and deprivation of liberty

The CYPDS recognises the heightened vulnerability of children and young people with disabilities to abuse, neglect and exploitation and will follow the processes set out here to keep them safe whilst enabling them to take up opportunities for education and leisure.

Some children and young people have complex disabilities that require restriction of their movement in order to safeguard their welfare, and this may amount to a deprivation of their liberty.

The CYPDS aims to protect the rights of all children and young people with disabilities whilst promoting their safety and welfare.

To achieve this, the service will follow the Deprivation of liberty policy that sets out the specific steps to be taken to safeguard children and young people's rights when packages of care may result in a restriction in their movements. 

The service will hold a Best interests meeting in these cases to explore the impact of packages of care and decide on whether the proposed care package amounts to a deprivation of liberty that needs to be authorised by the Courts.
